MIDYEAR MEETING ONE OF BEST, MEMBERS SAY
“You are the first to hear this information,” BrickStreet Insurance President and CEO Greg Burton said at the opening business session of the 2011 CAWV Midyear Meeting. “BrickStreet Insurance has earned a rating of A- from A.M. Best Company. This rating places the company among the most financially secure insurance providers in the nation and indicates we have an excellent ability to meet our ongoing insurance obligations.” Mr. Burton told members that a press release was being issued in West Virginia the same morning as his talk but members attending the January 29 - February 3 CAWV Midyear Meeting in Los Cabos, Mexico were the first to hear the news. A.M. Best is a full-service credit rating provider which focuses on the insurance sector. “We are pleased to be the CAWV’s workers’ compensation provider and we are pleased to share this exciting news at your meeting today,” Mr. Burton stated.
Also speaking at the opening General Business Session from BrickStreet were Jeff Benintendi, Lisa Teel and Allan Williams. “We want you to build value in your safety program by creating a safety culture in your operation,” Mr. Benintendi told members. “This culture begins with you and it flows through the company. If you own the culture, safety will be a priority down the line.” Mr. Williams gave members a comparison of direct and indirect costs associated with accidents. “Companies should provide incentives for employees who are found to be doing something right for safety verses providing disincentives for doing something wrong,” he suggested. Ms. Teel outlined the CAWV program and showed that trends were going in the right direction for members in the plan. “The number of claims are going down as are TTDs per claim,” she noted. “Members are also developing return to work programs and more claims are being reported in 48 hours or less, which is required by participants in the association’s plan.”
State and federal legislative issues were a major topic of the Monday Business Session. Louis Southworth, Jackson Kelly, presented his annual overview of the West Virginia legislative session. He brought members up to date on the changes within in the Senate leadership and the proposal to have a special election this year for governor. “Since everyone is running for election, no one wants to talk about tax or fee increases,” Mr. Southworth stated. “It will also be tough year to get meaningful tort reform legislation.”
Stephen Sandherr, CEO of AGC of America, participated via Skype for his presentation, titled “What Does the New Congress Have in Store for Construction.” Speaking from AGC headquarters in Washington, D.C., Mr. Sandherr brought members up to date on funding for highways, water/sewer and building, talked about the make-up of the Senate and House – including what influence Tea Party candidates will have in shaping policies such as OSHA regulations, highway reauthorization bill, spending cuts (including infrastructure funding), health care, immigration, tax cuts and credits and earmarks.
The Tuesday General Business Session was equally informative. A very definitive presentation on financial and tax changes for 2011 and beyond was given by Eddie Thompson, CPA, and Tim George, CPA, Brown Edwards and Company. Much of their presentation centered around how contractors can utilize the information in the bid process. “The Hidden Risks of Green Construction” was detailed by Tammie Alexander, Steptoe & Johnson. Sheila Coe, Heeter Construction and a member of the Board of Directors of the HUBZONE National Council, outlined the federal HUBZONE program and the benefits and requirements of being declared a HUBZONE contractor. She noted a number of federal projects that contain a preference for HUBZONE contractors. Pat McDonald, CAWV membership director ended the program with a demonstration of the new CAWV website which allows members to update their own information, and detailed the many affiliate programs provide deep discounts on services and products for members.

“The business sessions were superb,” stated CAWV President John Strickland. “We’re in Mexico and national events are brought to us live out of AGC’s Washington, D.C. office. Learning what should be included in our bid strategy and learning the ‘rest of the story’ in our legislative process have provided all of us valuable information,” the president stated.
The meeting contained a number of social networking opportunities including the opening night reception and dinner on the beach at the Fiesta Americana Grand Los Cabos in Cabo San Lucas, Mexico. Members enjoyed a number of activities including golf on the Ocean Course, which has been ranked #9 on Golf Digest Magazine’s list of “Top 50 Golf Hotels in the World.” Zip lining and rappelling in the Wild Canyon, deep sea fishing, shopping in the upscale Marina District of Cabo San Lucas, dune buggy and ATV rides through the Baja Peninsula, and the many Mexican restaurants in both Cabo San Lucas and San Jose, were enjoyed by members.
“I thank all the members who made this meeting a success,” said President Strickland. “We’ve gotten numerous requests to return to Cabo for a future meeting. We hope everyone will join us next year when our meeting will return to Aruba, February 3 - 8, 2012.”

LEGISLATIVE SESSION HITS HALFWAY POINT
Thursday marked the halfway point in this year’s legislative session. While there have not been a lot of bills introduced that directly affect the construction industry, the association has been busy this week dealing with bills that have unintended consequences which could impact contractors. These bills are being worked on in committees and legislative staff will be working to get all bills introduced by February 21, the deadline for introducing bills in the House and Senate.
Design-Build for highway contractors, revised International Energy Conservation Code, OSHA 10-hour safety bill and energy savings contract legislation are all somewhere in the legislative process and will be taken up in committee next week. Highway funding, or the lack thereof, raised to the forefront this week as Senate and House committees worked on possible funding options. FEDERAL TRANSPORTATION HEARING MONDAY IN BECKLEY AND CHARLESTON
U.S. House Transportation and Infrastructure Committee Chairman John Mica (R-FL) announced that West Virginia will be the first location in a series of national field hearings and public forums on pending major surface transportation legislation. The event will begin Monday, February 14, at 8:00 a.m. at The Theater at Tamarack, One Tamarack Park, Beckley, WV 25801. Click here to see the location on a map and get directions. Following the hearing in Beckley, a listening session will begin at 11:00 am at Yeager Airport in the Conference Room on the 2nd floor. There will be 7 people on the panel as well as Rep. Capito and Rep. Mica. The session will go until noon when they will have to get on a plane and go back to DC.
CAWV members are encouraged to attend the hearings which will inform the Committee’s drafting of a long-term reauthorization of the nation’s highway and transit programs. CAWV Vice President Gene Thompson will be making a presentation at the Charleston session. Association Executive Director Mike Clowser will be speaking at the Beckley hearing.
The committee will have a discussion about the future of the highway trust fund, and improving ways in which we finance roads. There will be a chance to submit reports for the record, and if there is enough time, a question and answer session with the public.

"Through my leadership on the committee, West Virginia will be sitting in the front seat as Congress writes a job-creating transportation bill to keep our economy on the road to recovery,” said Rep. Nick Rahall. “We are kicking off the national tour in Beckley so members of the committee can hear firsthand about the transportation challenges confronting our region," said Rep. Rahall, the ranking Democrat on the committee. "A long-term transportation bill will create jobs to put West Virginians back to work while growing our economy and ensuring safer and more efficient roads and bridges. I look forward to welcoming Chairman John Mica and Members of the committee to Southern West Virginia as the very first stop on this national tour."
The committee will seek input on how to consolidate and improve the performance of highway funding programs, cut government red tape and streamline the project delivery process, increase private sector investment in infrastructure, identify creative financing alternatives and other ideas for writing the legislation. The previous multi-year law (SAFETEA-LU) expired in September 2009.
YOUNG CONTRACTORS HOSTING LEGISLATURE DAY WEDNESDAY, FEBRUARY 16
“Whether we choose to become involved in the political process or not, the political process involves us as contractors every day,” said Young Contractors Chairman Rob Williams. “Don’t let the moment you need a favor be the first time you meet your legislator.” The goal of the Young Contractor’s Legislature Day, being held on Wednesday, February 16, is to help CAWV members understand the legislative process and meet their legislators. In addition to witnessing the floor session, this year’s event will also include the opportunity for our membership to meet personally with their local representative. This in-person meeting will allow our members to introduce themselves as voting constituents, as well as members of the business community. Further, the one-on-one meeting will provide the opportunity to discuss current legislation which has the potential to impact the way we do business (for examples see the latest CAWV Legislative Bulletin).
“Last year’s event was an eye-opening experience and this year’s will further each participant’s professional and personal development within the industry,” Chairman Williams said. GOVERNOR’S SERVICE AWARD ENTRY DEADLINE APRIL 13
Governor Earl Ray Tomblin has announced that he will be accepting entries for the 2011 Governor’s Service Awards until April 13, 2011. “This is an opportunity to recognize those who have made the greatest mark across our state through service,” Gov. A group of CAWV Young Contractors spent February 2 at The Clay Center CANstructing a bulldozer. The structure used over 1600 cans of food, which were donated to the Covenant House Food Pantry upon completion. The group was honored with the Healthiest Meal award at a ceremony held February 4. The CAWV Scholarship Foundation Board of Trustees has been traveling this week to state colleges and universities to advertise the association’s 2011 annual award program. The Foundation will visit schools that offer a civil engineering program, encouraging students to apply for the scholarship and distributing applications. In addition to the $4,000 award, the foundation typically makes several additional awards to students for their academic achievements. All CAWV members are encouraged to promote the annual scholarship program. Also, any member who knows of a deserving West Virginia college resident - sophomore, junior or senior - who meets the qualifications for the monetary award should advise them to complete and return an application form. Protecting Employees From Workplace Violence
Every employee expects their workplace to be a safe work environment. Unfortunately, times have changed, making risk management professionals and company managers focus more time on workplace violence to keep employees safe. Workplace violence can come from a variety of avenues, including threatening acts from employees, disgruntled clients or customers, and even follow over from employee domestic problems. Here are a few tips to help CAWV members keep their workplaces safe from threatening behaviors:
• First and foremost, don’t underestimate verbal threats or acts directed at an individual or others at work. Especially when the person exhibiting the threatening behavior has a history of this type of behavior.
• Secondly, don’t overreact to behavior that one shows when being upset at things like work schedule delays, and normal stress-related issues at work that cause us all at one time or another to “spout off” and get angry. This type of anger generally is focused on the thing, rather then posing a threat toward people.
• Do take any threat made seriously. Report any verbal abuse, statements that a person makes about harming or getting even, etc. Make sure the management team know the concerns.
• Do not confront individuals who exhibit threatening behavior. Reacting verbally to insults, and threats simply inflame the situation and may result in being physically harmed.
• Employees should be sensitive to other employees “stressors.” We never really know what kinds of threats of violence one might be facing or creating at home. Violent home relationships have many times spilled over into the workplace, with the abuser coming to the workplace and hurting or killing innocent employees to get to the person they’re after.
• Companies, regardless of size and type, should have an effective and strict, well enforced Workplace Violence policy in place, and it should be communicated to all employees so that they understand what to do in any event that they feel threatened.

HIGHWAY WORK ZONES..................CAUTION ! CAUTION! CAUTION!
Even when all traffic control measures are taken, a confused or unaware driver can crash through a work site, or a daydreaming worker can step into the path of a speeding vehicle. Some drivers take reckless chances by running stop signs or changing lanes without signaling. These unsafe acts jeopardize other drivers who may lose control of their vehicle while avoiding a collision. When work site involves moving traffic, safety awareness should be at its peak, to protect both the public and the crew. Some helpful tips to better prepare are:
Planning: All traffic control must be carefully planned and approved by governing authorities before work begins. The person responsible for this planning should drive through the traffic pattern before any work starts to ensure that the public will understand how to control their vehicles appropriately. If there is any possibility of driver confusion in the pattern, change it.
Signage: The Manual on Uniform Traffic Control Devices and local or state regulations should be followed for proper signage and barricading. Place initial warning signs a minimum of 1,000 feet from traffic revisions. All signs and related equipment should be in good condition and highly visible. In some cases, independent traffic safety contractors handle warning signs and barricades.
Barricades: Devices which guide traffic such as cones, barrels, etc., should be highly visible and spaced relatively close together, so drivers will not deviate from an assigned traffic flow. All such barriers should be made of material that will cause little or no damage if a vehicle contacts it.
Safety Gear: All employees should wear hard hats and must wear high-visibility orange or day-glow vests. When working at night, the vest should have light-reflective strips.
Flaggers: Roadside construction sites must have at least one individual assigned to traffic control. A highly visible sign paddle should be used during daylight hours. It should be octagonal in shape, at least 18 inches across, and have letters at least six inches high that say STOP on one side and SLOW on the other. Flaggers should have two-way radios. When flaggers are present, a sign indicating this must be placed a minimum of 500 feet from the beginning of the detour.
Vehicles: All construction vehicles should be equipped with backing alarms, two-way radios, and Slow Moving Vehicle signs when appropriate. Ideally, they should be painted a highly visible color and many jurisdictions also require flashing yellow beacons. All operators must be qualified and trained to operate the equipment they are using. If a vehicle is parked along-side the road, orange safety cones should be placed around it to alert drivers.
Night Work: If work is done at night, the entire site must be illuminated. Increase warning distances in areas of fast-moving traffic as light fails. Flaggers should have orange-cone flashlights and barricades should be equipped with flashing lights. Any excavations or utility accesses should be taped off and barricaded with flashing warning lights.
Training: All company employees and subcontractors involved in the project must receive an initial safety orientation, informing them of the potential hazards of the project, including traffic safety. Changes or unusual conditions should be communicated to workers immediately.

HOUSE BUDGET COMMITTEE HEARS ROAD FUND WOES
WVDOT Secretary Paul Mattox told the House Budget Committee Tuesday that the state’s road fund revenues are stagnant and have shown little growth since 1998. He also said that higher material and employment costs have caused the fund to lose about 30 percent of its purchasing power in the last 13 years. Mr. Mattox suggested giving counties more control over their local roads, as lawmakers discussed using the state’s Rainy Day Fund for secondary road repair. ROUTE 35 FINANCING PLAN DECISION DELAYED
Rising interest rates over the past few months have cast a major cloud over whether the Turnpike Authority can raise enough money with a bond sale to complete Route 35. The authority was scheduled to make a decision on the bonds this week, but has pushed the meeting back to February 18. That is just about the latest date officials can meet to approve the bond sale for the road. The $187 million low bid to construct the road expires Feb. 24, and officials will have to take further steps to get federal approval of the project before the bid can be awarded.
Transportation Secretary Paul Mattox told lawmakers two weeks ago that current estimates put the project about $40 million short of its goal. Both the Department of Transportation and acting Gov. Earl Ray Tomblin's office have been working in recent days to come up with some plan to fill in the funding gap. Gov. Tomblin's office has said "everything's on the table" when it comes to completing the road, but so far has not come up with a successful solution.
U. S. HOUSE PANEL ISSUES OVERVIEW OF PROPOSED SPENDING CUTS
U.S. House Appropriations Committee Chairman Hal Rogers (R-Ky.) this week released a series of spending cuts for 70 federal programs that would be included in his committee’s funding proposal for the remainder of FY 2011. While all federal discretionary programs, including those in the transportation area, have been funded at FY 2010 levels under a series of short-term extensions since the new fiscal year began October 1, the latest extension expires March 4.
Among the programs slated for reduction from the FY 2010 levels of investment by Chairman Rogers include: Environmental Protection Agency (by $1.6 billion), Clean Water State Revolving Fund (by $700 million), Drinking Water State Revolving Fund (by $250 million), High Speed Rail (by $1 billion),
Amtrak (by $224 million) and FAA Next Generation Air Traffic Control (by $234 million). While the federal highway, public transportation, and airport infrastructure programs were not identified in the announcement, the full list of program cuts will not be made available until the legislation is formally introduced.
Last week Chairman Rogers allocated funds to the Transportation, Housing and Urban Development Appropriations Subcommittee that would amount to a 17 percent reduction in budget (spending) authority from what was provided to the subcommittee in FY 2010. Some have misinterpreted this action as targeting the federal transportation programs for major reductions. The highway, transit and airport programs are considered contract authority, which is treated differently from a budgetary scoring standpoint than budget authority. As such, investment in these programs is not reflected in the allocation of budget authority.
This highly technical point is not intended to suggest the federal transportation programs will be immune from plans by the House GOP to dramatically scale back discretionary spending, but rather to clarify that such a proposal cannot necessarily be inferred from Chairman Rogers allocating funds to each appropriations subcommittee last week. The debate between the Republican-controlled House, more evenly divided Democratic Senate, and the Obama Administration over federal spending has been brewing for some time and will be launched with full force next week with the release of President Obama’s FY 2012 budget proposal and House consideration of a FY 2011 government-wide funding measure.
