STATE ENDS FISCAL YEAR WITH $300 MILLION SURPLUS - SEVERANCE, SALES AND INCOME TAXES PERFORM WELL
June 30 marked the end of West Virginia’s fiscal year. As predicted, the state ended with a $300 million budget surplus. “It's from severance. It's from consumer sales tax and personal income tax. That shows people do have confidence in the economy. They're spending money in the state of West Virginia,” acting Governor Earl Ray Tomblin told MetroNews Thursday. During interim meetings of the WV Legislature in June, leaders discussed what to do with the funds. Law requires half of any budget surplus to be deposited into the Rainy Day Fund until the fund’s balance reaches 10 percent of the General Revenue Fund, which is currently $4.01 billion. The fund is quickly reaching that threshold and legislators will have to decide how to proceed.
Discussions thus far have centered around either increasing the percentage of the General Revenue Fund that the Rainy Day Fund represents, using the excess to address the state’s unfunded Other Post Employment Benefits (OPEB), or dedicating it to the State Road Fund.
“Half of it goes into the Rainy Day Fund. The legislature has already appropriated about $45 million. So there will be4, in the neighborhood, about $100 million dollars left." He says as of now, he doesn't know how the legislature will choose to spend those dollars. But he believes it should go toward future expenditures. “Obviously we realize down the road in our six-year plan that we do have increased expenses, especially with Medicaid (costs) facing the state. So we will be taking that into consideration,” Gov. Tomblin said.

U.S. DOL PREVAILING WAGE RESOURCES AVAILABLE ONLINE
The U.S. Division of Labor’s Wage & Hour Division (WHD) has recently made a filmed version of their Prevailing Wage Resource Conference available on the DOL website. The recorded sessions include:
· An overview of government contract laws
· The Fair Labor Standards Act (FLSA)
· WHD’s enforcement of the Service Contract Act and its interaction with the Davis-Bacon Act (DBA)

CAWV “HARD AT WORK” SIGNS AND BANNERS AVAILABLE FOR MEMBERS

CHAFIN ANNOUNCES SUPREME COURT BID
Letitia "Tish" Chafin formally declared her candidacy for the West Virginia Supreme Court Thursday afternoon. Her husband, H. Truman Chafin, is a lawyer and longtime Mingo County legislator who served many years as the state Senate's majority leader. Mrs. Chafin’s law practice is based in Williamson. She is immediate past president of the West Virginia State Bar, a member of the Marshall University Board of Governors and an elder at First Presbyterian Church in Charleston. Her bachelor's degree is from Marshall, and her law degree from West Virginia University. Two full 12-year terms on the court will be available next year. Mrs. Chafin and incumbent Justice Robin Davis are the only Democrats to have announced they will run for the seats.
MCDONALD ATTENDS INSTITUTE FOR ORGANIZATION MANAGEMENT
Pat McDonald, director of member services for the CAWV, has completed his second year at the Institute for Organization Management, a four-year nonprofit leadership training program at the University of Georgia in Athens. “Institute graduates are recognized across the country as leaders in their communities,” said Raymond P. Towle, IOM, CAE, the U.S. Chambers’ vice president of Institute. “These individuals have knowledge, skills, and dedication to achieve professional and organizational success in the dynamic association and chamber industries.” Since 1921, Institute has attracted association and chamber professionals from across the country to its five university sites. During the four years, most Institute participants attend the one-week session at the same site, building valuable relationships with others in the industry. Graduates of Institute receive the IOM recognition, signifying completion of 96 hours of course instruction in nonprofit management.
MILEAGE RATE INCREASES JULY 1
Beginning on July 1, 2011, the mileage reimbursement rate that motorists can claim when using personal vehicles for business will increase to 55.5 cents per mile. The 4 ½ cent increase was sparked by high gas prices, according to the IRS, and will last through December 31, 2011.

INSTALLING SECURITY DEVICES
Many companies are investing in security camera technology to help prevent theft and identify thieves if material or equipment is stolen. One component that is many times overlooked is getting a security survey by a security professional to determine where cameras should be located.
While security cameras are very helpful in recording a theft, all too often cameras record the act and no one can be identified. Here are a few helpful tips about the installation and use of security cameras.
THERE ARE TWO PRIMARY USES FOR INSTALLING SECURITY CAMERAS
One is to deter a potential thief by placing cameras in obvious locations around your property, on utility poles, on outside rooftops, and placing signs all around the property that cameras are in use. Using cameras to deter thieves has a marginal impact on criminals primarily because most criminal activity is done after dark, and thieves are aware that it’s extremely difficult to identify them with cameras mounted 20 or more feet in the air looking down on them. All the crook has to do is to wear a cap or hooded shirt and they will likely never be identified.
The second way to use a security camera is as a tool to identify the crook. Nothing is more frustrating than to have invested in camera security, only to watch thieves carry out their mission and still no one can identify them. Camera placement is key. Well lighted grounds, equipment and buildings go hand in hand with the correctly installed security camera system.
While placing cameras high enough to view large areas of property, such as on poles and rooftops is good, they rarely catch a thief exposing his/her face.
Thieves work from ground level. Place some cameras in hidden locations at ground level to prevent the crook from finding it or knowing where it’s hidden, and strategically locate them so anyone walking or driving a vehicle onto your property will be clearly recorded.

SBA REDISTRIBUTES FUNDS FROM FAILED BONDS
Voters in Harrison and Upshur counties failed to pass bonds, freeing $21.5 million in School Building Authority of WV funding for redistribution to other projects. The SBA met Monday in Morgantown to allocate the money.

"I feel very good about the schools that were selected. I think they were excellent projects. Unfortunately we could not fund those projects at the April meeting. Today, we were able to do that, and we don't often get that opportunity," said Dr. Mark Manchin, executive director of the SBA. Of the 55 counties who asked for help, their bill totaled $2.5 billion. "And over the next ten years, with the funding that we have available, it's about $800 million. So we only have about one third the amount of money that we need to address all the needs in the state of West Virginia over the next ten years," Manchin said.
At the meeting, the authority also secured $16 million for 2012 school construction from the 2014 funding cycle. This will make about $30 million available for distribution in 2012, according to Dr. Manchin. In previous years, including 2011, the authority has been able to hand out $70 million or more because of the Qualified Zone Academy Bonds that were included in the American Recovery and Reinvestment Act. Moving around some of the funding from 2014 will guarantee no absence of funding cycles in the next few years. "We do not anticipate missing funding school construction in the foreseeable future," Manchin said.
School districts will have a chance to submit projects for Major Improvement Project Grant funding in December.
GOVERNOR DISTRIBUTES NEARLY $5 MILLION FOR CONSTRUCTION
Acting Governor Earl Ray Tomblin this week distributed $5 million in grants. The Charleston-Kanawha Housing Authority received $3 million to improve and add capacity to Littlepage Terrace. The City of Mount Hope received $1.5 million to remove dilapidated and dangerous residential structures, and the Boone County Commission received $450,000 to continue extending water service in the Route 5 / Prenter Road area.
HOUSE APPROPRIATORS ZERO-OUT GSA CONSTRUCTION FUNDING FOR FY12
On June 23 the U.S. House Appropriations Committee approved the fiscal year 2012 Financial Services and General Government Appropriations bill. The legislation provides annual funding for a variety of agencies including the General Services Administration. The bill includes a total of $19.9 billion in funding, which is nearly $2 billion - or 9 percent - below last year’s level, and nearly $6 billion below the President’s fiscal year 2012 request.
The General Services Administration’s (GSA) Federal Building Fund has borne the brunt of the cuts -- the bill allocates $0 dollars for design and construction services and only $280 million for repairs and alterations for FY 2012. This comes on the heels of the recent FY 2011 budget deal that cut the agency’s budget by $1.7 billion. The Committee is holding off on new construction of civilian Federal facilities as it and the Administration are concerned there are many unneeded and underutilized civilian Federal buildings that need to be taken off the Federal inventory.
In the meantime, the Committee has lent its support to the creation of a Civilian Property BRAC to address this issue. Both the Administration and the Transportation and Infrastructure Committee are considering proposals to create such a commission. It is expected at the end of this process there will be an inventory of federal structures designated for expanded use, reduced use, decommissioning, modification and sale.
AGC is working with Senate Appropriations leaders to voice concerns about these drastic cuts and will work to ensure the Senate provides funding for this critical program.

GOVERNOR DISTRIBUTES NEARLY $5 MILLION FOR CONSTRUCTION
Acting Governor Earl Ray Tomblin this week distributed $5 million in grants. The Charleston-Kanawha Housing Authority received $3 million to improve and add capacity to Littlepage Terrace. The City of Mount Hope received $1.5 million to remove dilapidated and dangerous residential structures. The Boone County Commission received $450,000 to continue extending water service in the Route 5 / Prenter Road area. The grant was awarded through the Community Development Block Grant program with funds from the American Recovery and Reinvestment Act of 2009.
In addition to the awards, acting Governor Tomblin recommended an additional $7.2 million in grant requests to the Appalachian Regional Commission. Projects include $1.3 million for the Oakvale Road PSD and $1.5 million for the wastewater system upgrades in Delbarton.

TAKE SAFETY INSPECTIONS AND AUDITS SERIOUSLY
One of the tools a company uses to keep updated on how their safety and health program is doing is to perform safety inspections and audits. Inspecting the work practices of employees and checking equipment to see that is still operating safely is just good common since. Auditing the safety and health program will normally result in finding weaknesses and create opportunities for improvement.
Many times safety inspections and audits will uncover flaws in the safety process that need to be corrected immediately. One of the most fundamental failures companies make is to either ignore the flaws they find in the safety program or simply “put off “ making the improvement until a more convenient time.
First and foremost, the willingness to ignore a hazard that you have uncovered can get one or more of your employees injured. Putting off making a correction is never a good idea. One of the ways to keep safety improvements on track is to include a responsible employee in the safety inspection process. Don’t fear getting the workforce involved. It will develop more trust and a better safety program.
Using the results of your safety inspection as a tool to find and fix safety flaws will not only go a long way toward preventing injury to employees, but will also reduce the liability of the company in the event of claim or law suit. Make the documented safety inspection work for the employees and the company.
Take the information generated as a result of safety inspections and make it work FOR you, not against you. Take safety inspections seriously. A safety inspection report can be a great tool to help a company grow and prosper, if it’s used to make improvements.
Create greater trust among employees and provide the safest work environment possible. Take safety inspections and audits seriously.

W.VA. PARKWAYS AUTHORITY CLOSER TO DEFERRED MAINTENANCE GOAL
Officials say an increase in tolls is allowing the West Virginia Parkways Authority to catch up with its 10-year deferred maintenance program. By 2016, the authority’s plan is to have the deferred maintenance down to $100 million, and to have it completely paid off by 2019. This date also coincides with the intended payoff of outstanding bonds. The current maintenance program began shortly after the 2009 toll increase from $1.25 to $2. Since then, roadwork has been done on everything from asphalt and pavement overlay, bridge retrofit work, toll plazas and culverts. Before 2009, 25 percent of the turnpike’s pavement was composed of older concrete. Currently, workers are putting in a 5 to 6-inch overlay of asphalt over the concrete which can be milled in the future. “Next, we’re looking at the mill and lay program which will mill off 1 to 2 inches of asphalt so we can put a fresh layer on there,” said Greg Barr, Parkways Authority General Manager. “We are looking to start this program around 2015 or 2016.”
The authority also wants to focus on the upkeep and rehabilitation on the turnpike’s bridges. “We have 116 bridges but only a couple of them are noticeable because of the overhead structure,” he said. “Many people don’t see the structure underneath the bridges and all the steel decks and cracks that need to be sealed or patched. We need to preserve these bridges because they are very expensive to replace.”
