HOUSE OVERWHELMINGLY SUPPORTS REPEAL OF 3 PERCENT WITHHOLDING

 

Thursday the House of Representatives, by a margin of 405 to 16, voted to repeal the 3 percent withholding law. The withholding rule will force large municipalities, states and federal agencies to withhold 3 percent of every payment to every contractor until contractors finalize their tax returns for the year. The legislation, H.R. 674, now goes to the Senate where AGC hopes there will be swift consideration. The Senate came within three votes of passing 3 percent withholding repeal last week, and this week President Obama stated his support for repeal.  Senator Joe Manchin voted for repeal and Senator Jay Rockefeller voted against it, citing concern with where the financial offset will come from. The CAWV will continue to work with Senator Rockefeller’s office to gain his support for the measure.

 

GOVERNOR WILL CONVENE LEGISLATURE ON NOV. 13 TO CERTIFY ELECTION RESULTS - INAUGURATION TO TAKE PLACE AT STATE CAPITOL

 

Governor Earl Ray Tomblin Tuesday announced that following the Secretary of State's confirmation that all counties have completed the canvassing and certification process required by law, he will issue a proclamation calling the WV Legislature into extraordinary session at noon, Sunday, November 13, 2011, for the purpose of certifying the results of the October 4 special gubernatorial election. Following the Legislature's certification, Governor Tomblin will be sworn in as Governor of West Virginia, at 3:00 p.m. on the afternoon of November 13.

 

"I am honored to have this opportunity to continue to lead West Virginia," Gov. Tomblin said. The swearing ceremony will take place at the State Capitol in Charleston. Gov. Tomblin has been acting as governor since November 15, 2010, when then-Gov. Joe Manchin resigned upon his election to the U.S. Senate. A new election required by the West Virginia Constitution for the remainder of former-Gov. Manchin's unexpired term was held on October 4, 2011. The Senate will meet later to elect its president once Gov. Tomblin resigns from the Senate.

 

CAWV BOARD OF DIRECTORS MEETING HELD

 

The CAWV Board of Directors held its Fall Meeting October 25 in the CAWV Conference Room.  Board members discussed a wide array of issues affecting membership and the industry, including legislation at the state and federal level, contributions to HUB/PAC, members’ support of West Virginians for Better Transportation’s strategic plan, a revamp of the CAWV’s annual safety awards program, and the association’s efforts to streamline environmental regulations. The board approved expenditures to help fund The Road Information Program (TRIP) and the Clean Water Construction Coalition (CWCC) in their efforts to promote investment in highway and water and sewer projects.  There was a lot of discussion on the 3% withholding requirement and its impact on CAWV members (see related story).

 


President Gene Thompson also appointed new chairs to HUB/PAC.  David Alvarez, MEC Construction, Inc., and Dan Cooperrider, WV Paving, Inc., have accepted the co-chair positions for the CAWV’s political action committee.  “Jim Ahern, our long-time chair, announced at the Annual Meeting that this is his last year as HUB/PAC chairman,” said CAWV President Gene Thompson.  “Jim has done a tremendous job in making the association’s PAC one of the predominate business PACs in the state of West Virginia.  We have been able to contribute effectively to candidates who give the construction industry a fair hearing on issues that come before the West Virginia Legislature.  Raising PAC funds is not an easy job, and it’s pretty much a thankless job.  Jim did it with enthusiasm and determination and our industry is much better because of it.  We thank Jim for all his efforts, and we appreciate Dave and Dan taking up the cause,” President Thompson said. Members will soon receive a mailing from HUB/PAC seeking contributions for next year’s election cycle.

 

The next meeting of the CAWV Board of Directors will be February 4 in conjunction with the CAWV Midyear Meeting, which will be held February 3-8, 2012 in Aruba.

 

DOUG CANTERBURY ELECTED WV CRUSHED AGGREGATES COUNCIL CHAIRMAN

 

Doug Canterbury, Boxley, Lewisburg, was elected Chairman of the West Virginia Crushed Aggregates Council at their meeting October 27.  He succeeds Ed Treadway, Pounding Mill Quarry Corp., who served as chairman since the organization’s inception in 1999.  “Ed has done a tremendous job in getting WVCAC up and running and making it an effective spokesman for the state’s aggregate industry,” said the new chairman. “We owe Ed a debt of gratitude for his dedicated service to WVCAC.”

 

WVCAC met in the CAWV Conference Room and heard a presentation from George Nadzadi, assistant regional manger of the Mine Safety and Health Administration (MSHA), Beckley.  See this week’s Heavy/Highway Bulletin for complete details.

 

LAST CHANCE TO REGISTER: CAWV / BRICKSTREET SAFETY SEMINAR, NOV. 2

 

The Contractors Association of West Virginia, in conjunction with BrickStreet, will hold a free Safety Seminar for BrickStreet policy holders on November 2 from 8:00 a.m. to 12:00 p.m. at BrickStreet, 400 Quarrier Street, Charleston.  The seminar is designed to elevate safety within members’ businesses.

Allan Williams, safety and loss control specialist for BrickStreet, will present information on their online safety management tools; Fall, Slip and Trip training; PPE Training and Safe Lifting Training.

WVBT CONFERENCE TWO WEEKS AWAY - REGISTER TO ATTEND OR EXHIBIT

 

West Virginians for Better Transportation will host its third statewide transportation conference -- the 2011 West Virginia Transportation Conference — on Monday, November 14, at the Charleston Embassy Suites Hotel.  The meeting is designed to provide attendees with information on important transportation issues and the outlook for transportation funding. BrickStreet Insurance is this year’s conference sponsor.

 

WVBT’s 2011 conference will provide updates on the state’s transportation plans as well as information regarding the outlook for state and federal funding. This year’s featured speakers will be two West Virginia congressional representatives who serve on the influential U.S. House Transportation and Infrastructure Committee -- Nick Rahall, who is the ranking member, and Shelley Moore Capito. Other speakers will include the chairs of the Finance Committees in the WV Legislature and WVDOT Secretary Paul Mattox. Sherry Conway Appel, the National Transportation Campaign Marketing Manager for the American Association of State Highway & Transportation Officials (AASHTO), will lead the attendees in a strategy session on how to position and promote transportation funding needs in a post-recession, budget-deficit world.

 

Attendees at the meeting will include manufacturers, truckers, contractors, suppliers, state and federal agency officials, engineers, local and statewide chamber’s of commerce, economic development authority representatives, travel and tourism professionals, educators, legislators and the media. Over 200 members have registered for the CAWV Midyear Meeting being held February 3 - 8, 2012 at the Hyatt Regency Aruba Resort and Casino. REP. CAPITO ASKS, “HOW IS GOVERNMENT HOLDING YOUR BUSINESS BACK?”

 

Rep. Shelley Moore Capito is seeking input from West Virginia’s business industry on burdensome government regulations. “Washington is in the way, threatening West Virginia’s small businesses with higher taxes, and more than 1,000 new costly regulations,” she says in a video request for assistance. SEN. MANCHIN CO-SPONSORS BILL TO REBUILD INFRASTRUCTURE

 

As part of his “Commonsense Ideas for a Stronger America” tour, Sen. Joe Manchin announced Monday that he is co-sponsoring the Rebuild America Jobs Act to invest $60 billion in infrastructure and produce jobs. This bill is expected to be introduced Oct. 31. “We are letting our infrastructure fall apart around us. We need roads, bridges and air traffic to give us the opportunity to compete globally,” he said. “Every job that is created by investing in our infrastructure will employ an American, and hopefully a West Virginian,” Manchin explained. The bill would invest $50 billion in transportation infrastructure and provide $10 billion for an infrastructure bank, which would create a public-private partnership to fund important development projects. According to Manchin, Moody’s estimates that for every $1 spent on infrastructure, Gross Domestic Product is raised by $1.59.  The bill would be paid for by a 0.7 percent surtax on millionaires — any income over $1 million. The 2012 CAWV Membership Directory / Buyers Guide was sent to state and federal agencies, coal companies, oil and natural gas producers and manufacturing businesses throughout the state. Procurement officers at the county, state and federal level now have members’ names and contact information at their fingertips. The Directory lists members alphabetically, by region, and by the products and services they provide. Through the years, the Directory has become a one-stop-shop for those looking for contractors, subcontractors and suppliers. The Directory was mailed and should have arrived on members' desks last week. Members are encouraged to familiarize themselves with the publication which features information about the CAWV, contact details for federal and state agencies, tax rates, and phone numbers for local municipalities.  Each member firm receives one free copy of the directory. CAWV AND SCHOOL BUILDING AUTHORITY FORM TASK FORCE

 

The CAWV and the School Building Authority of West Virginia have formed a task force comprised of CAWV building division members and architects. The task force, which represents several different trades,  will meet on Friday, November 4 at 10:00 a.m. in the CAWV Conference room in Charleston to give the SBA guidance on its new cost per square foot allowances as well as reviewing the SBA’s bidding procedures to evaluate if changes should be made that would be beneficial for all parties involved. OCCUPATIONAL NOISE EXPOSURE

 

 

Every year more than 30 million people in the U.S. are occupationally exposed to hazardous noise.  Noise-related hearing loss has been listed as one of the most prevalent occupational health concerns in the U.S. for more than 25 years.  Thousands of workers every year suffer from preventable hearing loss due to high workplace noise levels.  Since 2004, the Bureau of Labor Statistics has reported that nearly 125,000 workers have suffered significant, permanent hearing loss. 

 

Exposure to high levels of noise can cause permanent hearing loss.  Neither surgery or a hearing aid can help correct this type of hearing loss.  Short term exposure to loud noise can also cause a temporary change in hearing, such as the feeling of ears being stuffed up or a ringing in the ears (tinnitus).

 

Loud noise can also create physical and psychological stress, reduce productivity, interfere with communication and concentration, and contribute to workplace accidents and injuries making it difficult to hear warning signals.  Noise-induced hearing loss limits your ability to hear high frequency sounds, understand speech, and seriously impairs your ability to communicate. 

 

What are the warning signs that your workplace may be too noisy?

 


                      You hear ringing or humming in your ears when you leave work.

 

                      You have to shout to be heard by a coworker an arm’s length away.

                      You experience temporary hearing loss when leaving work.

 

 

What can be done to reduce the hazard of noise?

 


 

                      Choose low-noise tools and machinery

                      Maintain and lubricate machinery and equipment

                      Place a barrier between the noise source and employee (sound wall, curtain)

                      Enclose or isolate the noise source.

                      Operate noisy machines during shifts when fewer people are exposed.

                      Limit the amount of time a person spends at a noise source.

                      Provide quiet areas where employees can gain relief from hazardous noise sources.

                      Wear hearing protection devices (HPDs), such as ear muffs and earplugs.

SENATE TO CONSIDER TRANSPORTATION FUNDING BILLS NEXT WEEK

Last week the Senate considered, but was unable to set up, a final vote on a FY 2012 “minibus” appropriations package. However, after securing a unanimous consent agreement, Senate Majority Leader Harry Reid (D-Nev.) announced that a vote on final passage of the appropriations bill is scheduled for Nov. 1. The "minibus" includes FY 2012 appropriations bills for the Departments of Transportation, Housing and Urban Development, Agriculture and Commerce/Justice/Science. The Senate voted on several amendments to the package last week. Next week, under the unanimous consent agreement, the Senate will vote on additional amendments prior to a vote on final passage.

 

AGC has been closely monitoring the “minibus” debate to prevent any anti-construction industry amendments from being offered or voted on. In addition to the “minibus,” the Senate may vote on another round of stimulus infrastructure funding. The stand-alone bill that was part of President Obama’s “America’s Jobs Act” would provide $27 billion for highways, $9 billion for transit, $4 billion for high-speed rail and $10 billion for a National Infrastructure Bank. The bill will likely fail due to bipartisan opposition to further stimulus spending and a growing focus on a multiyear reauthorization of transportation programs. There is a growing bipartisan consensus that a multi-year surface transportation reauthorization would be preferable to another one year stimulus. Portions of the surface transportation reauthorization will be marked up in the Senate Environment and Public Works Committee on Nov. 9.

 

REPS. CAPITO, MCKINLEY SIGN ON TO INFRASTRUCTURE INVESTMENT JOB GROWTH LETTER

 

A group of House Republicans have sent a letter to the Republican House leadership stressing the importance of a multi-year federal surface transportation program reauthorization bill and a long-term revenue solution for highway funding.  In a letter to Speaker John Boehner and Majority Leader Eric Cantor, 47 Republicans, including Reps. Shelley Moore Capito and David McKinley, wrote “We support the efforts to provide a long-term sustainable revenue source for our nation’s transportation network.  Congress should prioritize efforts to create efficiency, reduce bottle necks and cut red tape...Passing a bill is an important aspect of the Republicans Jobs Agenda.  It is critical, however, that we act now.  We respectfully urge you to move a reformed and streamlined multi-year surface transportation bill that will support much needed economic growth throughout our nation.”

 

YEAGER AIRPORT ANNOUNCES $15 MILLION HILLTOP REMOVAL PROJECT

 

Now that Yeager Airport's 500-foot runway extension project is complete, the airport's governing board wants to remove a knoll in the Northgate/Coal Branch Heights area that lies in the path of approaching and departing aircraft.  Removal of the runway obstruction will involve moving nearly 1.3 million cubic yards of earth -- a process expected to cost about $15 million and last about two years.  The obstruction removal project would probably go out to bid in February, and be under construction in May or June. It should be complete by the fall of 2013.

The CAWV is pleased to announce the Certification Training Courses, which are offered annually to help individuals prepare for the WVDOH certification examinations required under their Quality Assurance Program, have been scheduled.  Thousands of individuals have attended courses in Compaction, Aggregates, Asphalt and Portland Cement Concrete over the last several years. Test comparisons prove that those persons who attend the CAWV/WVDOH courses have a higher success rate for passing the exams.

STATE CHANGING FORMAT OF AML PLANS AND SPECS IN PHYSICAL PLANROOM - ONLINE ACCESS UNCHANGED

 

The WV Department of Environmental Protection submits plans and specifications for nearly all reclamation work to the CAWV for members’ use in the Physical Planroom and online at www.isqft.com. They have recently notified the CAWV that after January 1,  they are going to begin sending plans and specifications for reclamation projects in electronic format. Association members will still have access to the projects online and in the CAWV Physical Planroom. However, paper copies of the documents will not be available for viewing. In lieu of sending paper, the WVDEP will be submitting plans and specifications on CD.  Plans and specifications in printed form and on disc will be available until January 1,  2012.  Plans for projects sent to the State Purchasing Division after that date will be distributed by disc only.  Members are welcome to use the discs while at the association headquarters and are able to check discs out just as they would paper plans and specs.

WVCAC RECEIVES OVERVIEW ON MSHA PROCESS, OPERATOR RIGHTS

 

George Nadzadi, assistant regional manger of the Mine Safety and Health Administration (MSHA), presented at the West Virginia Crushed Aggregate Council meeting on Thursday, October 27. The presentation,  titled “Leadership Responsibilities, ” gave an overview of how to avoid accidents on quarry sites as well as what to do when an accident occurs. Nadzadi said, “Although mining fatalities continue to drop, with 2011 on track to be the lowest fatality rate ever recorded, it is still imperative that everyone at a quarry site be able to spot hazards. Quarry operators are responsible for the training and safety of everyone on the job site, including sub-contractors that may be working on the site,” he added. “So operators, supervisors and foreman must be trained to lead by example which includes wearing personal protection equipment, avoiding hazards and making sure unsafe conditions are corrected.”

 

Nadzadi also discussed how to handle MSHA inspections and the different types of violations that can be assessed to an operator. He noted that an operator has the right to request a meeting with the inspector within 10 days after the inspection to discuss any violations that were written. The operator also has a right to contest any violations that they believe should not have been written or the severity of the violation. Nadzadi said inspections are mandatory by federal law and all violations must be cited by the inspector and all cited violations have to receive a penalty. “The field inspectors are highly trained but can still make mistakes so it is important to know your rights.” he said.
